Cause of action against local mart under consumer law

Cause of action against local mart under consumer law/ Business Law and Ethics

Localmart is a chain of Australian supermarkets. From 12th May 2015 until 16th June 2015, Localmart advertised in large print above the meat counter of their Greenmeadows store, “Special – Frozen Australian Salmon Fillets – 100g – $7.99”. A large number of customers of the Greenmeadows store have telephoned the Australian Competition and Consumer Commission (the ACCC) complaining that despite what is specified in the advertisement, the print on the side of the packets of Salmon indicated that it was actually sourced from Canada. Localmart have since confirmed that the salmon was indeed sourced from Canada.

Advise the ACCC as to whether or not they have a cause of action against Localmart under the Australian Consumer Law 2010 (Cth) and if so, the scope of any remedies they may pursue against them.
