You are a paralegal in the United States Attorney office. As a paralegal, you interview witnesses and prepare a legal analysis that your supervising attorney can use to make an initial assessment of the case. Acting on a tip from a government informant, agents from the Federal Bureau of Investigation (“FBI”) sought a warrant from a Federal magistrate to search the property of Garland Fold. Garland is a farmer on the Maryland Eastern Shore. The informant told the FBI that Garland Fold and his brother, Bruce Fold, were involved in several brazen bank robberies in Maryland and Washington, DC. He said that the brothers were heavily armed. He also told the FBI that the brothers were terrorist, and they were planning to contaminate the water supply in Washington, DC with lethal dosages of certain chemicals. The informant told the FBI that Garland was storing the chemicals in a barn on his farm. Therefore, the agents obtained a warrant to search the barn.

The FBI assigned four agents to execute the search warrant, the agents found Garland Fold in the farm fields. The agents chased him, and Garland fell in the fields after running 200 yards. The agents surrounded him, and they stood over him in an intimidating manner. The agents asked him his name, and Garland gave his name and proceeded to confess to the terrorism plot and storing the chemicals. The agents did not give Garland a Miranda warning.
