Discuss Legal concepts of stare decisis and legal precedent
1) What is the difference between the two (2) legal concepts of stare decisis and legal precedent. Why is it important for a paralegal to understand both concepts; how might they affect a paralegal’s work? Next, provide an example that a trainer could use in order to help explain the two (2) concepts to a new paralegal.
2) The Equal Protection Clause provides protections to both individuals and businesses. When you challenge a government action what test(s) will the court apply to determine if the action violates the Equal Protection Clause? If the goal is to treat everyone “equally” why has the court established three different tests to apply when a government action is challenged.
