With the exception of the Royal Metals, a similar principle used to apply under common law in the Australian colonies.
1. Trace the development of ownership rights in Queensland from being vested in the landowner to being vested in the State.
2. Discuss the social and economic advantages and disadvantages of the USA versus Queensland rights framework.
Part B – max 1,750 words
Examine and discuss local and global approaches designed to ensure that corporations remain ultimately responsible for mine reclamation works. You should consider issues such as takeovers, corporate insolvency and whether specific criminal sanctions should ever apply.
