Choose one of the following fact patterns and in your post identify the labor law or laws you read about in your lesson you think may apply, whether the law was violated and why or why you do not believe the law was violated.
A 52 year old male mid-level manager has been working for the company for 20 years. In his prior three (3) annual reviews he received an above average review and each year he has received a 3% raise. His immediate supervisor has recently been replaced and now he is being asked to do additional tasks and numerous responsibilities have been added to his workload by the new supervisor. Other managers at his same level are not receiving these additional tasks and responsibilities. In his last two (2) annual reviews he received poor scores and was then put on probation. He was terminated yesterday.
A 31 year old waitress at a hip restaurant in the city has the most experience of all the staff but when she got pregnant and could no longer work the hours required for the position she was terminated and replaced with a 20 year old waitress.
A 43 year old female bank teller employed for 5 years at the bank is the most reliable, hardworking and efficient employee. She has been recognized each year by the bank at the annual meeting for her excellent work with customers and her performance on the job. This year at the company summer picnic she brought her partner whom she began dating after the first of the year. The bank manager called her into his office on Monday following the picnic and terminated her without giving any real reason other than “it just was not working out” but the bank teller suspects it was her personal relationship that lead to her termination.
