Case Analysis
I. Read the judgment of Sackar J in Coles Group Property Developments Ltd
v Stankovic [2016] NSWSC 852 and:
a) outline the material facts of the case;
b) identify the relevant legal issue/s raised; and
c) explain the process of reasoning adopted by Sackar J and the
conclusions that he reached.
II. Suppose that Mr Stankovic had only ever remained in the Coles car park
between the hours of 7am and 11pm, that he had never remained for a
continuous period of longer than two hours, and that he had never been
issued with any kind of notice to cease trespassing. Do you think the
outcome of the appeal would have been different if:
a. the complaints detailed at [33] were nevertheless made out against
Mr Stankovic; or
b. the only complaint made out against Mr Stankovic was that he told
people that Mr Bunting ‘had breached the protocol regarding the
treatment of homeless people’?

Criteria for Marking
The following criteria for marking, measured against the grade descriptors set
out on pages 8–9 of the Course Handbook, will be applied (there is no specific
weighting given to each):
A. The accuracy of the analysis and summary of the case and reasoning.
B. The structure and organisation of the case analysis, including the logical
flow of the discussion, use of headings, etc.
C. The quality of arguments and reasoning used.
D. The quality of the writing, including grammar, spelling and proofreading.
E. The accuracy and consistency of referencing.
F. Compliance with the ‘General Instructions’ outlined below.
General Instructions – Please note the following:
1. ANONYMITY: The only identification is your student number. You must
not reveal your name anywhere on the assignment.
2. FORMAT: The assignment must be typewritten in one-and-a-half line
spacing. A 1-inch (2.54cm) margin must be included on the left, right, top
and bottom of the page, and both left and right margins must be justified
(i.e. the assignment is to be presented in ‘American’ or ‘Block Style’
layout). Your SID and the page number must be shown in the header on
each page of your paper.
References and citations must be included in footnotes. Footnotes must
not include matters of substance. Revise carefully for grammar and
spelling errors, as marks will be deducted for such errors.
You must use the Assignment Cover Sheet, which is available in the
‘Assessment’ folder on the iLearn site. When completing this cover sheet,
ensure that you clearly state the name of the subject, your student
number, your tutor’s name, group and meeting time, the title of your
assignment, and the word count. ALSO ENSURE THAT YOU REMOVE ANY
HIGHLIGHTING.
3. COPY OF ASSIGNMENT: You must retain a copy of the submitted
assignment. Although all care is taken by the Faculty with assignments
submitted in the prescribed manner, the onus is on you to produce a copy
of any submitted assignment in the event that it cannot be located by the
Faculty.

4. SUBMISSION OF ASSIGNMENT: An electronic copy of your assignment must
be submitted to Turn-It-In using the link provided on iLearn under
‘Assessment.’ Please ensure that you keep your Turn-It-In receipt as the
onus will be on you to prove that your assignment was correctly submitted
should there be any dispute in this regard. You are not required to—and
should not—submit a hard copy of your assignment in the locked box in
the Law Library.
5. LATE SUBMISSION: Applications for extensions should be made to the
course coordinator before the due date and time of submission.
Extensions on medical grounds should be supported by a medical
certificate. Extensions on personal or emotional grounds may be granted.
Extensions will ordinarily not be granted because of computer crashes or
because of multiple assignments and clashes of due dates. It is your
responsibility to manage your time efficiently and to take precautionary
measures such as making backup copies when using computers.
6. PENALTIES FOR LATE SUBMISSION: Where an assignment is not submitted
on time, a penalty of 10% of marks awarded per day late, to a maximum
of 60% of the marks awarded, will be applied. Papers received more than
7 days after the submission date without prior agreement will receive a
mark of 0.
7. REVIEW OF GRADES: If, after taking time to read and digest the comments
on the assignment, you believe that your mark is inappropriate, you may
seek a review of your mark within 14 semester days of its release. You
should first approach the Subject Coordinator (Iain Field,
iafield@bond.edu.au) to attempt to resolve any concerns by consultation.
Failing that, an application for review may be made to the Associate Dean
(Students) by submitting the appropriate form. Your mark will then be
reviewed by an independent qualified marker. You are warned that reviews
can lead to marks being moved downwards as well as upwards. Reviews
will be conducted in accordance with the rule in House v The King (1936)
55 CLR 499.
8. PLAGIARISM: Severe penalties are imposed for all forms of plagiarism. As
you are well aware, plagiarism is a serious offence. This is especially so in
the academic world. The sanctions, if you are found guilty of plagiarism,
are very serious, and may include a mandatory failing grade for the subject
and possible suspension or expulsion from the University. See Schedule B
of the Bond University Discipline Regulations.

summary of a case or statement of legal principles.
9. WORD COUNT: The absolute maximum word count for this Assignment is
1750 words. You do not have to use this many words to answer the
question, but you may not exceed this amount by any margin. Marks will
be deducted for any failure to comply with this requirement. The word
count of your paper (excluding footnotes) should be included on the
Assignment Cover Sheet.
