Question:

In 2007 Hari and Isla who had been going out together for about a year, decided to live together when they discovered Isla was pregnant with their first child. A house was purchased but registered in Hari’s name alone as Isla was just about to start maternity leave from her freelance work with a catering business, which would mean no income. The house was financed with the aid of a 90% mortgage from the Abbey Fiends Bank and the remaining 10% was provided by Hari’s parents who were delighted that they were finally going to be grandparents.

Hari worked as a surveyor throughout the relationship apart from a period of 6 months during 2012 when he was made redundant. Isla went back to work very part time after the first child was born in 2008 and when their second child was born in 2009, she stayed at home with the children full time. In 2012 she started working again so that she could contribute to the household finances which including paying the mortgage whilst Hari wasn’t working. The following year (in 2013) she set up her own catering company which has produced a very good regular income since then. She has managed to combine working with looking after the children and using a childminder which she paid for.  The couple maintained separate bank accounts throughout the relationship with Hari paying the mortgage out of his account and Isla taking responsibility for payment of food and utility bills.

The relationship has just broken down and Isla has come to you for advice on what her rights are in relation to the house.
