1.Identify one facet of the legal system, for example, the court system, history, legal process, and then summarize its major characteristics and how they apply to business.
2. Describe the steps in the litigation process and compare them to a form of alternative dispute resolution(ADR). Then, describe a case where ADR would be the preferred form of dispute resolution and a case where traditional litigation would be the preferred method. Finally, explain your answers.
3. We often hear the term “due process”. What does that mean in the legal environment? Does and/or should it differ in the traditional legal system versus methods of ADR? Does it and/or should it have application in the business environment as well? Why or why not? Thoughts?
4. Discuss the difference between at least two different forms of business, such as sole proprietorship, subchapter S, partnership, limited liability partnership, and limited liability company? Discuss in what business setting you would want to use each type and discuss whether one form is better suited than another? Explain your answers.
5. The American Legal System is divided into criminal and civil law? The two types of law have different standards of proof. For instance, O. J. Simpson was a defendant in both a criminal and civil trial. In the criminal trial, he was found not guilty. However, in the civil trial, he was found liable. Why the difference? What are the essential difference between criminal law and civil law?
