In 2001, the US Securities and Exchange Commission And the Prosecutor’s Office carried out a case concerning the sale of shares of the company ImClone Systems on the basis of the unscrupulous use of inside information. The prosecution was widely publicized, resulting in prison terms for celebrity Martha Stewart, ImClone executive director D. Samuel Waksal and Stewart runner at Merrill Lynch, Peter Bacanovic. The purpose of this activity is to analyze the information elements of the case, in order to answer the following questions: A) Why was Inside Trading charged in this case? B) In what terms are the decision makers responsible for this case C) What were the consequences of this case for the company ImClone Systems? For your shareholders? To the general public? D) What ethical dilemmas regarding the use of inside information can be extracted from this case? E) Consider a company in which a GIS is implemented.
